NOTE:
The Mid-West Planning District (MWPD) is able to provide written letters outlining the characteristics and status of property with our office.
Zoning Memorandum: Written letter that identifies whether all building and structures identified on a site and typically by a legal survey conforms to the siting requirements in the applicable municipality's Zoning by-law. It will outline if the property's current use and siting is legal, non-conforming or illegal. If any areas are non-conforming or illegal, it will list the items and the conditions in which they would need to be brought into conformance.
It will list any active Conditional Uses or Variances, active permits, active violations and active orders.
Requests for this type of Zoning Memorandum must include:
- A written request, including the legal and/or civic address of the subject property and the applicant's contact information as well as a description of the existing use on the property and/or the proposed use;
- A Building Location Certificate (BLC) for the subject property;
- Fees in accordance with the MWPD’s Fee Structure By-Law
NOTE:
A Zoning Memorandum without a BLC can be issued if no buildings currently exist on the property.
A modified version of the Zoning Memorandum can be issued without a BLC if there are existing buildings/structures, but the evaluation is then done based on the Manitoba Land Use and Development map and conclusions will not be guarantees, but approximations that would need to be confirmed with a BLC eventually.
Zoning Confirmation Request: Written verification for a specific property the land use designation per the Development Plan and zoning per the applicable municipality's Zoning by-law. It will also list the designated front site line and if there are any amendments or repeals to the Development Plan or Zoning by-laws that are in progress.
