The Mid-West Planning District (MWPD) is able to provide written letters outlining the characteristics and status of property located within the District boundaries.
Zoning Memorandum:
A person with an interest in a building, parcel of land or operation involving the use of land may apply to the planning district for a zoning memorandum that states whether or not the building, parcel, use, or intensity of use appears to conform with the zoning by-law.
If any areas are non-conforming or illegal, it will list the items and the conditions in which they would need to be brought into conformance.
The memorandum will also list any active Conditional Uses or Variances, any active permits, violations, and orders associated with that property.
If there are any Development or Zoning by-law amendments in progress that may affect the property, they will be listed as well.
Requests for this type of Zoning Memorandum must include:
- A written request, including the legal and/or civic address of the subject property and the applicant's contact information as well as a description of the existing use on the property and/or the proposed use;
- A Building Location Certificate (BLC) for the subject property (created by a MB Surveyor); and
- Fees in accordance with the MWPD’s Fee Structure By-Law
NOTES:
A Zoning Memorandum without a BLC can be issued if no buildings currently exist on the property.
A modified version of the Zoning Memorandum can be issued without a BLC if there are existing buildings/structures, but the evaluation is then done based on the Manitoba Land Use and Development map and conclusions will not be guarantees, but approximations that would need to be confirmed with a BLC eventually.
Certificate of Non-conformity:
A person with an interest in a building, a parcel of land or an operation involving a use of land that does not comply with the current zoning by-law may apply to
the planning district or municipality for a certificate confirming that the building, parcel, use of land, or intensity of use was lawfully in existence before the enactment of the zoning by-law. The certificate is conclusive evidence of the facts stated in it.
Requests for a Certificate of Non-conformity must include:
- A written request, including the legal and/or civic address of the subject property and the applicant's contact information as well as an description of the existing use on the property;
- A Building Location Certificate (BLC) for the subject property (created by a MB Surveyor); and
- Fees in accordance with the MWPD’s Fee Structure By-Law
